General Rental Terms and Conditions Home Stay Thailand Rural Holiday 48, M-1 Road, Phraeksa, Khok Sawan, Pla Pak, Nakhon Phanom, 48160 Applicability • These general rental terms and conditions apply to reservations and agreements regarding the holiday home mentioned above. • In these general rental terms and conditions, the term "renter" means the person who enters into a rental agreement with us regarding the rental of the holiday home. • These general terms and conditions apply regardless of your (prior) reference to any of your own terms and conditions or other general terms and conditions. We reject all general terms and conditions to which you refer or which you use. • Agreements deviating from these general terms and conditions are only valid if agreed in writing.
Article 1 - Reservations 1. We only accept reservations from persons aged 18 or older. Reservations made by persons under this age are also not valid. We reserve the right to refuse a reservation at any time without giving reasons. 2. After you have made a reservation, you will receive confirmation, the general rental terms and conditions, and an invoice from us within five days. The terms and conditions described in Article 2 apply to payment of the invoice. 3. We request that you check these documents for accuracy and inform us immediately of any inaccuracies. If you have not received confirmation of receipt from us within 10 days of making the reservation, please contact us immediately. Failure to do so will result in the reservation being cancelled. 4. An agreement between you and us is concluded when we confirm the reservation. This agreement concerns the rental of the holiday home for recreational use.
Article 2 - Payment 1. The following conditions apply to payment: 1. Payments must be made by bank transfer; 2. You must pay 35% of the rental amount as a deposit. The remaining 65% of the rental amount must be paid one month before the arrival date. 3. If your reservation is made within one month of the arrival date, you must pay 100% of the invoice amount upon receipt of the invoice. Payments 2. must be made by bank transfer to IBAN: NL 93 SNSB 0957 1310 46 in the name of J.R. van der Star, stating the invoice number. By paying a (partial) payment of or the entire rental amount, you confirm that you have read and agree to the general rental terms and conditions. The rental period ends automatically after the agreed period has expired. In the event of late payment, as described under a. of this article, you will be in default immediately after the payment term expires. In that case, we reserve the right to cancel your reservation and terminate the agreement.
Article 3 - Deposit 1. A deposit of €100.00 will be charged upon arrival. This deposit serves to cover any damage and/or costs in the broadest sense of the word that we may retain if the tenant and any accompanying persons fail to fulfill their obligations as a good tenant. 2. The deposit must be paid upon arrival. 3. If the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we are also entitled to terminate the agreement with immediate effect. 4. The deposit or any remaining balance will be refunded immediately upon departure, after deduction of any claims (e.g., damage to inventory/holiday home and/or other costs). 5. If, in the event of any damage, it appears that the deposit is insufficient to cover the full amount of the damage, we reserve the right to hold you liable for the (remaining) damage.
Article 4 - Changes 1. If the tenant wishes to make changes to the booking/agreement after it has been concluded, we are not obligated to comply. It is our discretion whether and to what extent changes are accepted. In principle, changes are not permitted within 4 weeks of arrival. 2. If, after the booking/stay period has been concluded, the tenant changes to a different or non-consecutive/adjacent stay period, the cancellation policy as stated in Article 5 applies. A different stay period is understood to mean any period that does not fall within the stay period reserved by the tenant (and confirmed by the landlord).
Article 5 - Cancellation Cancellation by the tenant must always be made in writing (by mail or email). The following conditions apply: • Partial payments will not be refunded in the event of cancellation. • For cancellations up to 42 days before the arrival date, 25% of the rental fee is due. • For cancellations up to 28 days before the arrival date, 35% of the rental fee is due. • If you have not arrived within 24 hours of the agreed date without further notice, this will be considered a cancellation, and 35% of the rental fee will be due. • In the event of cancellation by us, any amounts already paid will be refunded.
Article 6 – Key Receipt. 1. The key is available upon arrival. We will loan the key to the holiday home to the tenant. The key remains our property. In the event of loss, theft, or any other misplacement of the key, the tenant will be liable for a fee of €15.00. 2. All costs incurred as a result of not returning the property on time will be charged to you. We will store any items found after your departure for a reasonable period, but we accept no liability for them. Any subsequent delivery will be at your expense.
Article 7 - Accommodation in the holiday home The following periods and times apply to reservations/stays: 1. Weekend: Friday from 12:00 PM to Monday 11:00 AM; 2. Midweek: Monday from 12:00 PM to Friday 11:00 AM; 3. The tenant and other users must behave responsibly in and around the house during their stay. 4. On the day of arrival, you can generally use the house from 12:00 PM. On the day of departure, you must vacate the house by 11:00 AM. 5. The holiday home is non-smoking. Smoking is permitted outside on the terrace. 6. Open fires are not permitted outdoors. 7. Pets are permitted. 8. The rental price excludes final cleaning and bed linen and towels. A charge of €25 per rental period applies for this service. 9. Barbecues are permitted using the provided barbecue (it must be left clean before departure). While water and electricity are included, we kindly request that you use them sparingly. 10. The occupancy of a holiday home by more people than agreed upon (at the time of booking), or the maximum of six people applicable to the property, is expressly prohibited without our permission, unless otherwise agreed in writing. 11. Moving cupboards and beds, as well as sound or television equipment, or taking any part of the (indoor) inventory outside is strictly prohibited, with the exception of the crockery/glasses and cutlery for your meal outside.
Article 8 - Force Majeure 1. Force majeure on our part exists if the performance of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond our control, including the risk of war, strikes, blockades, fire, flooding, and other disruptions or events.
Article 9 - Liability/Complaints/Damage 1. The tenant and other users are fully and severally liable for all damage to the house, its inventory, and all items belonging to the rented property during the relevant rental period, unless the tenant and other users can demonstrate that the damage is not attributable to them. We therefore recommend that you thoroughly inspect the inventory for defects upon arrival at the holiday home. If you discover any damage or defects, please report it to us immediately. 2. We accept no liability for theft, loss, or damage of or to property or persons, of any nature whatsoever, during or as a result of your stay in the holiday home. 3. We accept no liability for construction activities on (main) roads, etc., in the vicinity of [the property]. We accept no liability for the failure or inoperability of technical equipment, utilities, or the partial or complete inactivity of the internet and/or TV. 4. We are responsible for the costs of normal maintenance and repair of defects. If defects occur, the tenant must notify us immediately and follow our instructions as much as possible. 5. Should you still wish to file a complaint, it must be submitted to us in writing and with reasons within 14 days of leaving the holiday home.
Article 10 - Departure and Final Cleaning In the event of improper use or leaving of the holiday home, additional (cleaning) costs may be charged to the tenant. • Upon departure, after the end of the stay, the tenant must: • Leave the house clean and tidy. • Have washed everything, dried it, and put it back in the closet. • Beds must be stripped, and duvet covers and linens must be folded and placed on the floor. • Leave the washing machine, dryer, and refrigerator clean and empty. • Bring food and do not leave it in the closet(s) and/or refrigerator/freezer. • Keep the pillows tidy. • Empty the trash cans. • Report any breakages and/or damage. Article 11 - Applicable law All our terms and conditions, including the rental agreement/house rules, and any disputes arising from them, are governed exclusively by Thai law.
